REGULATION OF POLITICAL PARTIES: THE CURRENT STATE AND DIRECTION OF REFORMS
The project (funded by the European Union) was undertaken by the ODIHR with the fundamental objective of strengthening democratic processes in Ukraine and Moldova. It recognized the great interdependence of political party regulation system and the general level of democracy in each distinct country. In this perspective the logical way to develop the democratic institutions was first of all the reformation of party regulation system in these countries. This initiative was realized in the Project Analysis and Recommendations for Reforms of Political Parties Legislation and Regulation in Ukraine.
In the first stage of project implementation in Ukraine expert from the Agency for Legislative Initiatives (ALI) Denys Kovryzhenko have been asked to draft a critical report on Legislation and Regulations Pertaining to Political Parties in Ukraine using the questionnaire adapted from the analytical questionnaire for Guidelines on Legislation on Political Parties which are being developed by the ODIHR in co-operation with the Venice Commission.
The OSCE-ODIHR in cooperation with ALI also organized several events, which had an aim to involve leading experts in the field of political parties to the process of elaboration of key recommendations. In particular, within the framework of these activities the Agency for Legislative Initiatives and the OSCE-ODIHR organized round table “Regulation of Political Parties in Ukraine: the Current State and Direction of Reforms”, which took place on March 30, 2010, and brought together the experts from donor community, academia, think tanks and state bodies.
The second phase of project implementation involves a more ambitious programme of consultation and outreach, centered on the analysis and recommendations contained in the draft country report. This phase was realized in several steps:
- focus groups in Chernigiv, Lutsk and Kyiv, which were held at the end of April and brought together representatives from leading political parties to discuss the draft report in an intimate and confidential atmosphere, in order to “reality test” some of the report’s recommendations;
- an international conference on political party regulation and legislation in Ukraine bringing together leading experts, stakeholders, parliamentarians, policy-makers and civil servants to discuss and consult the report and its recommendations.
Following the consultation and discussion activities, the draft report on Legislation and Regulations pertaining to Political Parties in Ukraine was updated, incorporating key recommendations and comments, and edited for final publication.
As the National Report on Legislation and Regulations Pertaining to Political Parties in Ukraine was published the Project entered the third and the final phase: Promotion and Dissemination of Report Regulation of Political Parties in Ukraine: Current State and Direction of Reforms. On this stage three Roundtables were organized: on October 12 in the office of Parliamentary Committee on State Building and Self-Government, on November 18 in Lviv, and on November 24 in OSCE Project Coordinator's Office. One of the consequences of these discussions was a suggestion for the Parliamentary Committee for State Development and Local Self-Governance to establish a working group to analyse the proposals on the improvement of the functioning of political parties. This provides the initiators and the executors of the project for further development of the initiative to reform the party legislation in Ukraine.

The round table was aimed to discuss the key findings and recommendations of the Report on Legislation and Regulations Pertaining to Political Parties in Ukraine, comissioned by the OSCE-ODIHR and drafted by Denys Kovryzhenko, expert of the Agency for Legislative Initiatives. The results of the discussion were supposed to contribute to further improvement of the report, to encourage debates on regulation of political parties in Ukraine at national level and, in general, to contribute to the ODIHR’s work in development of the Guidelines on Legislation Pertaining to Political Parties.
The round table brought together Representative of the Secretary General of the Council of Europe for the Coordination of Co-operation Programmes with Ukraine, representatives of the EU Delegation to Ukraine, the OSCE-ODIHR, Friedrich Ebert Foundation, Konrad Adenauer Foundation, International Republican Institute, National Democratic Institute, Parliamentary Development Project II, Ukrainian-European Policy and Legal Advice Centre, USAID, Ukrainian think tanks, academia and public officials from the parliamentary committee on state building and local self-governance and Ministry of Justice of Ukraine.
The following issues were discussed in the round table:
-
the possibility of registration of regional political parties;
-
the procedure for registration of political parties in Ukraine, the grounds for cancellation of registration of political parties;
-
the grounds for termination of local party organizations as legal entities;
-
regulation of membership in political parties;
-
internal party democracy;
-
possible changes to electoral systems for local and parliamentary elections;
-
funding of political parties.
Focus groups
Within the framework of the project, the Agency for Legislative Initiatives organized three focus groups which took place on April 28-30, 2010, in Lutsk, Chernigiv and Kyiv. The focus groups had brought together the officials and members of all the leading political parties represented in the legislature, as well as representatives of some political parties which did not meet the electoral threshold in the last parliamentary elections.
In particular, the focus group meetings were attended by the representatives of the Party of Regions, the party “All-Ukrainian Association Motherland”, the party “Our Ukraine”, the political party “Civic Party Pora”, the Ukrainian Peeople’s Party, the party “Front for Change”, the Communist Party of Ukraine, the Socialist Party of Ukraine. Each focus group lasted from 3.5 to 5 hours and was aimed to discuss the key findings and recommendations of the Report on Legislation and Regulation of Political Parties in Ukraine, commissioned by the OSCE-ODIHR and drafted by Denys Kovryzhenko, the expert of the Agency for Legislative Initiatives.
The discussion was centred on the points defined by the ALI on the basis of a workshop that took place on March 30, 2010. This workshop had revealed that some European practices and standards in the field of political parties and electoral campaigns, recommended to Ukraine by the OSCE-ODIHR and the Venice Commission, were not supported by some experts.
Therefore, a particular emphasis was placed on discussion of the recommendations of the Venice Commission and the OSCE-ODIHR, and on possibility of implementation of such recommendations in Ukraine’s reality. Hence, the list of points for the focus group discussions included such issues as the procedure of registration of political parties, possibility of registration of regional parties, granting foreign citizens the right to be members of political parties, the grounds for prohibition and cancellation of registration of political parties, internal party democracy, funding of political parties etc.

This conference became a final event in a wide range of consultation and discussion activities, carried out jointly by the OSCE-ODIHR and Agency for Legislative Initiatives (ALI), and aimed to test key findings and recommendations of the draft Report on Legislation and Regulations Pertaining to Political Parties in Ukraine. These activities included, in particular, the round table “Regulations of Political Parties in Ukraine: the Current State and Directions of Reforms” that took place on March 30, 2010 in Kyiv; three focus groups that took place from 28-30 April 2010, in Lutsk (April 28, 2010), Chernigiv (April 29, 2010), and Kyiv (April 30, 2010), and an international conference “Regulations of Political Parties in Ukraine: the Current State and Directions of Reforms” that took place on May, 21, 2010. The Report on Legislation and Regulations Pertaining to Political Parties in Ukraine was commissioned by the OSCE-ODIHR and drafted by Denys Kovryzhenko, the expert of the ALI.
The international conference brought together a significant number of key stakeholders, in particular, MPs from both coalition and opposition, members of the Central Election Commission, the representatives of the leading political parties in Ukraine, the Ministry of Justice, the OSCE-ODIHR, the OSCE Project Co-ordinator’s office in Ukraine, the UNDP, NDI, IRI, Konrad Adenauer Foundation, the Parliamentary Development Project in Ukraine, academics, experts from leading national think tanks (the Razumkov’s Center, the Analytical Center “Open Policy”, the Electoral Law Institute, the Center for Applied Political Studies “Penta”, the Committee of Voters of Ukraine, the Foundation “Democratic Initiatives”, the Ukrainian Independent Center for Political Studies and other), and public officials.
Following recommendations were identified during the International conference for consideration of politicians and for reflection in the draft Report on legislation and regulations pertaining to political parties in Ukraine:

to unify regulation of political parties in Ukraine;
-
to establish mechanisms that encourage participation of political parties in elections independently of each other rather than in electoral blocs;
-
to repeal the constitutional provisions regarding introduction of “party administered mandate”;
-
to change the electoral systems for parliamentary and local elections in a way that voters have the possibility of voting for candidates rather than for a list of candidates;
-
to allow independent candidates to stand for local elections;
-
to bring into correspondence with European standards the regulations for establishing and terminating the activities of political parties;
-
to define in the Law on Political Parties the procedure for reorganization of political parties;
-
to consider the possibility of introducing mechanisms to promote greater representation of women in elected office; and in the territories where minorities constitute a significant part of the population – to consider mechanisms for increasing the presence of minorities in local representative bodies;
-
to bring the regulation into compliance with the European standards on fighting corruption in the financing of political parties and election campaigns, in particular, to re-introduce direct public funding of political parties.
“Promotion and Dissemination of Report Regulation of Political Parties in Ukraine: Current State and Direction of Reforms”

Among the participants of these event were Members of the Parliament, members of the Central Election Commission, representatives of the Ministry of Justice, other public institutions, experts of the OSCE/ODIHR, foreign and Ukrainian experts in the field of party regulation and electoral legislation, representatives of expert and academic circles, local authorities, local organisations of political parties, NGOs, foreign diplomatic missions and international organisations represented in Ukraine. One of the consequences of these discussions was a suggestion for the Parliamentary Committee for State Development and Local Self-Governance to establish a working group to analyse the proposals on the improvement of the functioning of political parties. This provides the initiators and the executors of the project for further development of the initiative to reform the party legislation in Ukraine.
Also, as logical developments of this web-site section it was suggested to elaborate an All-Ukrainian Expert Forum on Political Parties in Ukraine. It is constructed on the structure of the National Report and will include the expert materials on this subject in respective topic sections. Different experts in the field of party regulations can propose his or her materials to be included in the section. In such a way a special expert discourse for party regulation in Ukraine will be formed.
